The banks have mounted
several successful defences of such claims and are now fighting
every single case in court. Only joking!!
The
opposite is in fact the case.
Not
defending. Not
turning up at court.
Allowing judgements to be entered against them.
Even though the banks are electing to settle rather than defend, one
thing is certain.
They are extremely good at delaying settlements.
Letters are frequently lost.
They
often do not comply with the 40 day deadline to provide the relevant
paperwork. As a consequence the Information Commissioner's Office is
snowed under with complaints against banks. Don't believe us? Ring up
the Commissioner's Office.
Also, the banks will try not to deal with us. Why? Because they know we
will more than likely get more money on your behalf.
Even though the banks are aware of our involvement they will try and
persuade our clients to settle for an amount which is often far less
than the amount to which they are entitled.
DON'T fall into this trap. DON'T negotiate with the bank directly, they
will try and rip you off further with a quick offer of settlement that
is far less than the amount to which you are LEGALLY entitled.
One
